“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof…”
– First Amendment, United States Constitution
There are two parts to First Amendment religious freedom. The part before the comma is
the Establishment Clause. Originally, most scholars think it just meant the federal
government couldn’t establish an official religion for the nation. Over time, it has been
interpreted more broadly to mean the government can’t promote any specific religion, or
religion in general. This gets tricky. It’s why there can be a Christmas tree in front of City
Hall in December, but not a Nativity Scene. A Christmas tree, while certainly a Christian
symbol, is widely seen by many as more of a generic holiday decoration while a Nativity
Scene is a depiction of a specific event in the Gospel of Luke, part of the Christian New
Testament.
The part after the comma is the Free Exercise Clause, and means the government can’t
interfere with a person’s right to practice their religion in most cases. This can also get
tricky. Courts have ruled that legitimate practitioners of certain indigenous American
religions can use peyote – an illegal Schedule I controlled substance – in religious
ceremonies. On the other hand, you can’t practice human sacrifice, no matter how
sincerely you might believe in it.
Joseph Kennedy was a football coach at Bremerton High School. He prayed at midfield
after each game – first alone, but later with players and even some members of the
opposing team joining him. After a scene that the school district describes as chaotic, with
spectators and reporters knocking down members of the band in an effort to join Kennedy
at midfield, the school district told him that his prayers violated the district’s policy and
offered him other options to pray – for example, after the crowd had left. Kennedy
continued to pray at games, prompting the district to place him on administrative leave
and, eventually, decline to renew his contract for the following season.
On the one hand, Kennedy – by all accounts – did this on his own, and those who joined him
did so voluntarily. On the other hand, this was a public display of religion led by a
government employee on a field owned and operated by the taxpayers in conjunction with
a government-sponsored sporting event.
Where should we draw the line between prohibiting the government from “establishing”
religion and a policy that would unconstitutionally interfere with a person’s free exercise
of their religious faith?
Find the 2022 U.S. Supreme Court opinion in Kennedy v. Bremerton School District. Write
our usual 2 page double spaced essay. Explain what the majority decided and why. Explain

Select a film that relates to theories/concepts we have been focusing upon in this course. Any film can be rendered applicable, so the choice of film is completely up to you.
In a 4-6+ page paper present a theory/concept(s) related to race/ethnicity that we have studied and apply that theory/concept(s) to examples from the film you chose to exemplify the theory/concept(s). Be sure to include scholarly sources to provide context and to support your assertions.
Include citations for all direct quotes and references to texts and all other sources used. MLA, APA, ASA, or any other format you are familiar with is sufficient.
Scholarly Sources: All scholars refer to one another’s writings to support our own ideas. Scholarly sources include books, journal articles (use the library to find lots of great journal articles; JSTOR is very useful), and government documents (Census, Bureau of Labor Statistics, etc). Newspaper articles, Wikipedia, websites, online blogs, etc. are not scholarly sources (they can be used for additional information or context).

Civil Liberties
Civil liberties, which is about your rights as an individual. Civil rights concerns protecting people from discrimination because of their inclusion in some sort of group or class – race, religion, etc.
Sometimes, at least today, civil rights seems like a pretty simple concept. It’s illegal (and wrong) to deny somebody a job simply because they’re black, or refuse to rent someone an apartment because they’re Jewish. Sometimes, though, it gets more complicated.
Gerald Bostock is a gay man who worked as a child welfare services coordinator for Clayton County, Georgia. The facts are a little more complex than this, but he was basically fired from his job for being gay.
Title VII of the Civil Rights Act of 1964 prohibits employment discrimination because of an “individual’s race, color, religion, sex, or national origin.” The question before the court: Does “sex” in this context include sexual orientation? Or does it just mean you can’t favor a man over a woman or vice versa?
For this assignment, read a case called Bostock v. Clayton County . Note that Justice Neil Gorsuch, generally considered one of the court’s most conservative members, authored the opinion for the 6-3 majority of the Court in favor of Mr. Bostock.
Write our usual 2 – 5 page essay about it. Make sure you essay tells your reader: ● The basic facts of the case. ● What the majority decided, and why. ● Justices Alito and Thomas authored a dissenting opinion. Why did they disagree with
their colleagues? Why did Justice Kavanaugh write a separate dissenting opinion? ● If you were on the Supreme Court, how would you have ruled, and why? ● The Supreme Court, in my opinion, will soon face more complex cases involving the
application of protections on the basis of “sex” to transgender and non-binary individuals as our society grapples with a more complex understanding of gender. Do you have any guidance for the courts or Congress as these issues evolve?
