Explain how the Pre-Socratics (i.e., The Materialists, which excludes Pythagoras), and Socrates and Plato (you may include Pythagoras here) view: 1) the ultimate nature of reality, 2) how do we know it, and is knowledge apriori (within us at birth) or a posteriori(learned through experience)? How did they answer the question of the nature of permanence and change?

Answer first, in general, how did the Pre-Socratics (i.e., The Materialists, which excludes Pythagoras), and Socrates and Plato (you may include Pythagoras here) view: 1) the ultimate nature of reality, 2) how do we know it, and is knowledge apriori (within us at birth) or a posteriori(learned through experience)? How did they answer the question of the nature of permanence and change?

Then, second, after comparing and contrasting the Pre-Socratics and the ancients after them through Plato (there is overlap), what do believe the nature of reality to be? With which of these philosophers do you agree the most and why?

Analyze the differences among accounting profit, operating cash flow, net cash flow, and free cash flow.

Discussion 2: Evaluating Profit and Cash Flows
Any manager’s job is to help the firm maximize its value, which is based on future cash flows. In order to understand future cash flows, informed managers must study their firm’s financial statements. You studied various profit and cash flow concepts in your accounting course. With this knowledge, you developed a good feel for how well a company was doing historically. Your focus in this course is to develop capabilities in interpretation and use of these concepts. No matter what role you fulfill in the organization (e.g., marketing analyst, accounting manager, operations director, etc.), your knowledge of how to use financial data will enable you to provide good estimates of the impacts of future managerial decisions on improving the firm’s profitability and cash flow enhancement.
To prepare for this Discussion, think about your organization or an organization with which you are familiar. Consider the importance of accounting profit, operating cash flow, net cash flow, and free cash flow for informing how the organization operates with regard to decision making. Also, consider how financial markets can affect future cash flows.
Note: If you are not in the position where you are involved in forecasting cash flows and profitability, interview either someone in your organization or a professional outside of your organization who can provide you with this information. In your post, be sure to identify the position held by this person.

• Analyze the differences among accounting profit, operating cash flow, net cash flow, and free cash flow.
• Identify the key stakeholders in cash flow planning and profit estimation processes in the organization and explain how they are involved in the processes.
• Analyze the impact of accounting profit, operating cash flow, net cash flow, and free cash flow concepts on decisions in the organization for which you currently work, one that you would like to work for in the future, or a small business you hope to start one day.

Describe and analyse marketing activities associated with the launch of an improved product or service

Describe and analyse marketing activities associated with the launch of an improved product or
service
-> It needs to be an existing product/service in an existing company (my opinion is that it can be
improved into perhaps a more eco-friendly product/service, since sustainability is quite popular
nowadays – not necessary; it’s just my opinion).
-> The essay needs to show that I have accessed good quality secondary research information on my
market and product (e.g. Mintel) and that I have used the ideas about marketing from the unit (from
the 8 lecture powerpoints I have uploaded).
VERY IMPORTANT:
1. A very detailed analysis on how to structure the essay and what to mention can be found in the
“Assessment Brief” and “Assignment Brief” files that I have uploaded.
2. I have also uploaded an “Essay Q&A” where the lecturer has answered important questions about
the essay.
3. I have uploaded the 8 lecture powerpoints. Each section of the essay relates to a lecture: it is
expected to see the concepts, models and theories from each lecture applied to the product/service to
justify the decisions made for the marketing plan that is being produced.

Advice
Important information
The Law undergraduate guide (LUG) contains definitions of words used in TMA questions. It also gives advice on referencing and the reference list you must include at the end of your TMA. You should read this guide before attempting TMA 02.
Preparing for this essay question
This essay is asking you to discuss the mechanisms used to control exclusion clauses and unfair terms in a consumer contract. You were introduced to the nature of terms and different types of terms in units 4 and 5. These two units discussed how express terms and implied terms will form part of a contract. In unit 6 you developed your understanding of exclusion clauses (terms) and how legal rules have been put in place to control the use of exclusion clause and unfair terms. This essay is asking you to undertake an evaluation of the legal rules that deal with these clauses. You will need to explain why the Consumer Rights Act 2015 was introduced and evaluate its effectiveness.
You will need to refer to your Contract Law textbook. Chapter 6 of Furmston (2017). Pages 243-263 provide a good overview of the legal rules dealing with legislative provisions and in the latter section of this reading the focus is on consumer contracts and the Consumer Rights Act 2015.
Unit 6 of your module materials will provide you with materials that will support you with your preparation for this essay. This unit provided information on the role of legislation and how it is used to control exclusion clauses and unfair terms. In particular you should consider the materials dealing with the Consumer Rights Act 2015. This legislation was introduced to you in unit 5 and was developed in unit 6.
You may also consider the Law Commission report which provided advice for the then Department for Business, Innovation and Skills (BIS) which was produced in March 2013. This report provided advice for the BIS department on unfair terms in a consumer contract and is available using this link.
You may also use the following articles to consider the reasons why the Consumer Rights Act 2015 was introduced and they have considered the effectiveness of this legislation:
• Cartwright, P. (2016) Redress Compliance and Choice: Enhanced Consumer Measures and the Retreat from Punishment in the Consumer Rights Act 2015, Cambridge Law Journal, Vol.75, Issue 2, pp.271-300.
• Giliker, P. (2017) The Consumer Rights Act 2015 – A Bastion of European Rights? Legal Studies, Vol.37, No.1, pp.78-102.
Focus points whilst preparing your essay
The learning outcomes for this essay are explicit. They are asking you to:
• Discuss the mechanisms used to control exclusion clauses and unfair terms in a consumer contract – you need to demonstrate your understanding by discussing these mechanisms. Say how exclusion clauses and unfair terms are controlled when dealing with a consumer contract.
• Explain why the Consumer Rights Act 2015 was introduced – you need to explain what the problem was and why this legislation was introduced.
• Evaluate the effectiveness of the Consumer Rights Act 2015 – you need to assess this legislation. Has it solved the problem? You must demonstrate evaluative skills whilst addressing this learning outcome.
Finally, you should end your essay with an appropriate conclusion that is consistent with the explanations you have given throughout the essay. You have been asked whether or not you agree with the statement. Please ensure you address this part of the question.
Referencing
You may refer to the Law undegraduate guide (LUG) which will provide additional guidance on referencing, structure and the word count. In TMA 01 you developed your in-text referencing skills, structure and your presentation of your reference list. Please ensure you demonstrate these skills when presenting your completed assessment.
Cite Them Right
Students should note that for almost all OU modules whose presentation begins in or after October 2021, students are instructed to use the Cite Them Right (CTR) version of Harvard (instead of OU Harvard) for referencing.
Students studying Law undergraduate modules should use:
• the CTR version of Harvard for general academic sources, for consistency with the rest of the OU
and
• the CTR version of OSCOLA (Oxford University Standard for the Citation of Legal Authorities), for consistency with almost all the other Law Schools in England and Wales, for all items identified under the ‘Legal’ tab in the CTR version of OSCOLA.
Most Law assignments will require both types of reference, so each piece of work is likely to include:
• Harvard in-text citations, and a reference list, for general academic sources
and
• OSCOLA in-text footnote numbers, and footnotes, for legal sources.
Additional information on referencing is available in the LUG.
Check the meaning of verbs
To ensure that you answer the questions properly, use the LUG to check the following:
• the meaning of ‘describe,’ ‘explain’ and ‘evaluate’ – ‘Words used in assessments’

carry out an Environmental Risk Assessment for the proposed spray-painting activity described above and prepare a short report for the workshop manager summarising your findings

Background
A small local garage that currently offers vehicle repairs and vehicle servicing wants expand its service list to offer to car bodywork repairs to their customers. This will allow them to repair dents and scratches to car body work for their customers. Repairing car body work is a multi-step process and in the final step, isocyanate paint and lacquer is applied to the vehicle using a spray paint gun to match the original colour of the car. This assignment is only focussed on the spray-painting part of the body work repair process.
The company plans to focus on repairing small dents and scratches, so they intend to use a process called SMART (Small and Medium Area Repair Technique) spraying. After preparing the area around the scratch or dent the technician uses a mini-spray gun to apply the paint in an appropriate colour to match the rest of the bodywork. As the jobs undertaken using SMART spraying are small, it usually takes less than a minute to apply each coat of paint, but some jobs will require 3 or 4 coats.
The paint used for SMART spraying is known as 2K Acrylic Paint. This must be mixed with a hardener (2K Air Dry Hardener fast) before spraying. Without the hardener the paint will not dry. After application, the paint is left to dry and harden on exposure to air for several hours. The material safety data sheets for both the 2K Acrylic Paint and the 2K Air Dry Hardener have been provided (see Other Information).
The company does not have a budget to spend on a specialist spray-painting booth, so the workshop manager has suggested that a small room at the back of the workshop is converted into a spray-painting room. The plan is to install a heavy-duty air extraction system to draw fumes out of the room through the back wall and vent them to atmosphere. Before being vented to atmosphere, the extracted air will pass through a filtration system to remove any airborne paint particles. Workers will be advised to wear, overalls, gloves, a respirator before entering the room and to turn on the extractor fans before beginning to apply spray paint. The technical data sheet for the proposed respirator has been provided (see Other Information). Other workers must not enter the spray-painting room while spraying is in progress.

Other information
• The Material Safety Data Sheets (MSDSs) for 2K Acrylic Paint and 2K Air Dry Hardener are given as separate pdfs
• The Technical Data Sheet (TDS) for the respirator that the workshop manager would like the technicians to wear while spraying is given as a separate pdf

The assignment
Your assignment is to carry out an Environmental Risk Assessment for the proposed spray-painting activity described above and prepare a short report for the workshop manager summarising your findings. A template for this Environmental Risk Assessment Report has been provided. Your task is to complete each section of the report template as follows.

1. Introduction: Write a short introduction to the report to set the scene.
2. Risk Screening: Carry out a risk screening process for the spray-painting activity. You should present your risk screening in Table 1 of the provided template.
3. Event Tree OR Fault Tree Analysis: Choose ONE Source-Pathway-Receptor from your risk screening matrix (i.e., choose one row of Table 1). Prepare EITHER an Event Tree OR a Fault Tree to identify the range of consequences or combination of conditions that lead to a particular undesired outcome. It should be a QUALITATIVE assessment only (i.e., there is no need to put numerical values to each branch of the tree). You should present your Event Tree or Fault Tree as Figure 1 in the provided template.
4. Mitigation Measures: Use Table 2 in the template to:
a. Suggest the mitigation measures that the company could implement to reduce the environmental risks associated with the spray-painting activity.
b. Explain how these mitigation measures will reduce the environmental risks.
c. State which of the mitigation measures you would recommend reducing the risks to an acceptable level.
d. Provide a justification for your recommendations.
5. Discussion: Write up a short analysis of your findings.
6. Recommendations: Summarise the conclusions you have drawn from the study and the recommendations you would make to the workshop manager.

Your report should be no longer than 2000 words, not including references.

Other information
• You must complete each section of the template provided (1. Introduction, 2. Risk Screening, 3. Event/Fault Tree, 4. Mitigation Measures, 5. Discussion, 6. Recommendations). Do not change the wording or remove these section headings. You must include your completed Tables 1 & 2 and your completed Figure 1 as described in the template – i.e., do not change or remove the column headings in the tables. You may add a title page, contents page, sub-headings, other diagrams or images, and additional tables if you wish, but do not remove any of the elements of the template.

• You will be scored on each section of the report (1. Introduction, 2. Risk Screening, 3. Event/Fault Tree, 4. Mitigation Measures, 5. Discussion, 6. Recommendations). If you miss out a section or if you do not include Table 1, Figure 1 and Table 2 as described, you will lose marks. Make sure they are all included!
• Submit your assignment as a Word document.
• You will need to do your own additional research around the subject in order to fully answer this assignment. Make sure to properly reference any sources that you use.
• References should be listed on an extra page at the end of the template. References are excluded from the word count.

Explain the transferability of the leadership skills to your home country and your personal development?

Guideline –
(Kindly refer the group report, presentations and all the attached documents) Introduction: at the starting point, you need to mention the background that would be
linked to the aim of the project and provide some overall insights about the aim and
organisational context that will help the reader to get the full picture of the subject and
the project. Then introduce the reader to the overall structure of the report ? about 500
words
The main body: in this part you need to divide it into different parts and focus on the
theoretical framework that you used in the Part one: the group report (Attached in documents) You need to criticise the theory and defend the use of such theory in the project. Advantages and
disadvantages are quite important (about 1650 words)
In our Boviaid group project we didn’t use any theoretical framework but in Individual report we have to mention about a theoretical framework which we could have used in our group project and give out its advantages and disadvantages.
Part 2: Reflective statement – you need to tell the reader, what did you gain from this
route (group consultancy project)? What are the evidences that you can provide (use the appendices here)? You should reflect on the principles of ethics, sustainability and responsibility that are relevant to your project. Specifically, you should show evidence of evaluating, comparing and
contrasting relevant principles and proposing solutions. You should also reflect and
discuss how the principles of ethics, sustainability and responsibility inform your
professional practice when carrying out this project.?( about 700 words)
Questions to be answered in reflective statement.
1.After completing the group task, what is your perception of leadership?
2. What leadership skills you gained from this module as an international student?
3. Explain the transferability of the leadership skills to your home country and your personal development?
4. How did this route influence your perception of leadership?
5. What do you need to include in this module to improve your leadership skills?

– Conclusion: about 150 words to summarise the overall report at the end.
– List of references: you need at least 30 academic sources in APA 7th referencing format.
– Appendices: use as appropriate. Make sure you refer to these appendices in your text.
-You need to add the timeframe of your work in this part at the end
