Week 5 MemoryA great deal of controversy has surrounded the phenomenon of false memory syndrome and the implications that it has had in our society, particularly in the legal realm. One of the most influential psychologists in the area of memory and eye witness testimony is Dr. Elizabeth Loftus, who has spent three decades as a research psychologist and memory expert in legal cases. To learn more about the controversy surrounding false memory syndrome, visit the online LA Weekly website athttp://www.laweekly.com/2004-08-19/news/memory-and-manipulation/ to read the article, Memory and Manipulation.
Based on the points that the Loftus article brings up and our textbook readings this week respond to the following:What kind of implications do particular limitations of human memory have on the use of eye-witness testimony in criminal and civil court cases?
Week 6 The Stanford Prison Experiment ( 5 messages – 5 unread ) New messages Hide Full Description
Below are the Week 6 Forum Topic instructions. General posting requirements can be viewed by clicking the Week 6 Forum “View Full Description” link on the Forums screen under the heading “Forum General Posting Requirements”.Our textbook discusses one of the most famous psychological experiments of all time, conducted by Dr. Philip Zimbardo and his colleagues at Stanford University. To read more of the details of this experiment, visit http://www.prisonexp.org. Take some time to watch the video on the Zimbardo Prison Experiment by clicking here. After reading about the experiment, exploring the website and watching the video, answer the following:
1. Was it ethical to do the prison study in the way that Zimbardo conducted it? Why or why not? Explain your position substantively.
In responding to the above, keep in mind that morals and ethics aren’t the same thing. Morals are right vs. wrong behavior internal compasses that guide personal life decisions and are grounded in family beliefs, faith traditions, etc. Ethics are standards of behavior established by a professional organization, such as the American Psychological Association. You may have very strong feelings about whether the Zimbardo study was moral, but here we are discussing ethics.
2. How do the social psychology concepts of conformity and the power of the social situation that we are studying this week relate to what happened during the brief period of time that the prison study ran. Where in the description of how the study unfolded did we see evidence of these concepts?
Ground your answer to the questions in #2 in our assigned readings for this week and think social psychology. For example, the guards were given power over the prisoners and having power may affect others’ obedience to one’s rules, but one can affect obedience one-on-one as we see in the Milgram study. What we mean when we say “the power of the social situation” is the impact that being with others in a group setting, whether public or private, has on people’s behavior, such as the degree to which they conform to perceived norms. Be sure to check before posting that you have answered all of the questions, that you are basing your statements on concepts from textbook readings where required and that your post meets the general posting requirements located under the View Full Description link below the main Forum heading.
Week 7 Psychological Disorders
This week we studied psychological disorders. Which of the disorders covered in our textbook do you think would be the most challenging to have and why? Which of its symptoms would prove the most difficult for you. What what you most need from society if you had the disorder you selected?
Although any psychological disorder has challenges, here you must choose only one. You don’t have to be a trained professional to answer this question; just think about what you believe would be challenging in general and particularly difficult about a particular disorder.
Because one never knows who might have a disorder (people with psychological disorders are in society, around us all the time), we always want to use respectful language and avoid words like “crazy” or “insane” or statements like, “That would be horrific to have” or “I would want society to put me away if I had that…”. These are all words that have been used in past posts used with no intent to hurt others but which still can sting.
In preparation for this portion of the Week 8 Forum topic, you are encouraged to visit the site, Lost Among Us at http://lang.sbsun.com/projects/lostamongus/displayarticle.asp?part=6&article=art02_saida03and learn about the case of Saida Dugally, a real-life woman who suffered from bipolar disorder until her tragic death in 2003. On this web resource you will find videos of her story and the time-line of her decline into mental illness, as well as journal excerpts and photos from her life.
Saidas story is but one among many. According to the National Institutes of Mental Health (NIMH), an estimated 26.2 percent of Americans ages 18 and older about one in four adults suffer from a diagnosable mental disorder in a given year.

Auteur Project (250 pts)You will be selecting a filmmaker from the list provided and conducting an auteur study of that director, watching at least 2 of her/his/their films, researching their lifeand work, observing their characteristic themes and stylisticchoices, and presenting what you found in an online Auteur Workshop(small group forum on Brightspace) during our final week of thesemester. Depending on the director you choose, you will beplaced into a smaller group to post/share/present/discuss your work. Group pages will be established on our course site.Format & Submission: This project contains three components: RESEARCH & WRITING: a 3-4 page research and analysis paper, with Works Cited, summarizing the results of your research and screening of your chosen directors work, submitted using Turnitin AND posted to your assigned Auteur Workshop Group Forum. PRESENTING: selecting a representative film clip to be posted/linked to the Auteur Workshop Group Discussion Forum AND the whole class forum (called Auteur Directors Extravaganza!), including a 2-3 paragraph presentation to introduce and analyze the clip, explaining why it is an interesting example of the work of your chosen director. WORKSHOPPING: reading your groupmates papers, participating in a group interview, and discussing each others directors in your Auteur Workshop Group Forum. Your Projects are DUE Friday, July 26th by midnight (or earlier): your research and analysis papers are to be submitted on Assessment/Assignments AND uploaded to your Auteur Workshop Group Forum, along with your 2-3 paragraph presentation and clip. Your presentation and clip are also due on the whole class forum Auteur Directors Extravaganza!Your groups discussion forum and interview (with Amanda and your groupmates) will continue through Sunday, July 28th, to wrap up by midnight (or earlier) While you will be presenting and discussing your chosen director in a group, this is NOT a group project! You will be completing your own study of your chosen director and will be solely responsible for your work, and only your work.Director Selection: Take a close look at the list of directors provided below and pull out a few directors who speak to you; spend some time on www.imdb.com to learn more about each one! Also check out how readily available their films are to you library, rental, online, etc. Then SELECT ONE DIRECTOR – your top choice, followed by your second and third, just in case by filling out the attached form and copying it into an e-mail to me. I will accept and approve your requests on a first-come-first-approved basis, beginning immediately! We are aiming for a diverse selection of filmmakers to explore and a manageable number of people in each group, so I am asking for your back-up choices just in case. If your first choice director is already taken we will move down your preferences. There are plenty of filmmakers to choose from; however, this is not an exhaustive list! So if you are interested in working on a director not listed, please let me know on your form and I will likely okay it!FIRST REQUESTS ARE DUE: Wednesday, July 17th by midnight (or earlier!) CORRECTIONS AND LATE REQUESTS WILL BE ACCEPTED THROUGH: Saturday, July 20th Research: Use our CCC libraries and other trusted research resources to do some research on your selected directors life and work. Be sure to find reliable sources! (e.g. Wikipedia is NOT a reliable source!) Dont forget to start with our text and make use of their bibliographical references! Search our librarys databases for academic/film journals! You should end up with a variety of sources books and academic journal articles are the most trustworthy; online sources are iffy, so you should only rely on these for immediate and/or extra information and make sure that they are .edu, .org., or .gov with a reputable author! Once you have found your sources, read them, taken notes, and used them to gain a strong understanding of your director and her/his reception in the film world. You will use this research in your paper and provide a Works Cited page. Screening: Use all available sources at your disposal to locate at least TWO film selections from your director (the more the better, though!) Here are some suggestions: your favorite video rental place, Netflix, Amazon, Hulu, Chicago Public Library, HWC collection (please search our library catalog and see me for access), Facets www.facets.org, film collections at other colleges and universities (if you have access), film student friends, each other! If you run into trouble finding anything, ask for help sooner rather than later! Once you have the films in hand, screen them in their entirety! Watch for similarities in style, narrative, content, symbolism, and technique; take notes; look for evidence of your research. Assessment 1 instructions: financial condition analysis
Create a 4-6 page report that analyzes financial ratios for a company, uses the data to tell the financial story of that company, and concludes with a recommendation on whether the company would be a viable partner based on its financial condition.
Introduction
Its essential for senior management to know the financial condition of an organization in order to make strategic decisions. In this assessment, you will apply the financial management skills learned thus far.
Tell the financial story based on financial statements.
Conduct a financial analysis and identify focus areas for enhancing shareholder value.
Interpret ratio computations that are meaningful and inform business decisions and strategies.
Make three recommendations that maximize shareholder value.
Scenario
Maria Gomez is founder and president of ABC Healthcare Corporation, a company that owns hospitals, ambulatory surgical centers, urgent care centers, and outpatient clinics. She has called on you to review various financial documents and to make recommendations to maximize shareholder value.
Your Role
You are one of Maria’s high-performing financial analyst managers at ABC Healthcare Corporation and she trusts your work and leadership.
Requirements
Here is what your report should provide for Maria:
A summary of the financial strength of the company through your analysis of the price/earnings and price/book ratios.
The CFO for ABC Healthcare Corporation assessed the market value by reviewing its price/earnings ratios. The price/earnings ratio determines the market value of a stock as compared to the company’s earnings. The price/earnings ratios are listed in the chart below. To calculate the price/earnings ratio, the CFO took the earnings per share and divided that into the market value. As an example, this means that in 2019 investors were willing to pay $12.10 for $1 of earnings.Price/Earnings Ratio201920182017Market Price83.6283.6283.62Earnings Per Share6.917.879.15Price/Earnings Ratio12.1010.639.14
To further assess market value, the CFO looked at book value per share. The book value per share ratio is the per share value of a company in terms of the equity available to stockholders. The book values per share over the past three years are listed in the chart below:
Price/Ratio Ratio201920182017Market Price83.6283.6283.62Book Value per Share199.1209.05226Price to Book Ratio.42.40.37
The price-to-book ratio (P/B ratio) compares a firm’s market capitalization to its book value. It’s calculated by dividing the company’s stock price per share by book value per share. Here, for fiscal year 2019, the book value per share ratio was 0.42. This explains that investors were willing to pay $0.42 for $1 of book value equity. Price to book value is an important measure to see how much equity shareholders are paying for the net assets value of the company. P/B ratios under 1 are typically considered solid investments.
Based on your analysis, what is your general perception of the companys financial strength? Is it performing well given industry standards? How does it compare to its closest rival, HCA Healthcare? What information do you need in order to conduct such an analysis?
Given your review, how can it maximize shareholder value? What are focus areas for enhancing shareholder value for the long term? What short-term steps might be necessary for longer-term gains?
In your analysis you may choose to look at competitive data. You may calculate ratios to gain a true comparison.
After conducting your analysis, provide at least three recommendations to Maria that maximize shareholder value.
Deliverable Format
Create a report that tells the financial condition of this company. Your report should provide information on the following:

PeerResponse 1:The 2 models of change that I chose to discuss are the transtheoretical model and the socioecological model. Each model has a different approach to change, but they also complement each other well. The transtheoretical model focuses on the idea that behavior is changed on a continuum of 5 definitive stages of motivation to change. The 5 stages are precontemplation which is the stage before change is a thought. Contemplation where the person has a desire to make a behavior change soon which would be up to 6 months away. Preparation is the stage where the pros outweigh the cons to change a particular behavior in the coming future. Action stage is where there are efforts made to change. The last stage is the maintenance phase where the person has been consistent with the change and continues to work on not relapsing. The key to this model of change is the concept of change being fluid and that the individual may move up and down the different stages multiple times before they have effectively changed a behavior. It is not a linear process and once you reach the maintenance phase that does not mean that you may not be in the precontemplation phase again on the same behavior. Socioecological model focuses more on the individual person and the social and environmental factors that are barriers to change and contribute to causes of negative or unhealthy behaviors. This model talks about the varying intrapersonal, interpersonal, cultural norms, social networks and public and federal policies that contribute to reasons change has not been made. Both models discuss behavior change with one being more focused on how change is made and the other on why change is not made. The best example that I can think of to show how both models are used together would be in the case of substance abuse. An individual with addiction has many factors that are mentioned in the socioecological model that hinder their ability to change their habits and addictions. There are many personal, social, environmental and public and federal factors that hinder an individuals choice to change. The person may live in an area where drug use is rampant and may even come from a family of addicts. They may only socialize with addicts and frequent places that hinder their ability to want to change. According to the transtheoretical model when the individual has no thoughts of changing, perhaps due to their circumstances, they are in the precontemplation phase. Some people can fight against their social and economic status and enter the next stages of change.

Peer Response2:The Health Belief Model and the Health Promotion Model are based on individual behavior patterns and subjective health choices. Behavioral patterns, such as smoking, diet, and exercise account for nearly 40% of premature deaths (Nash et al., 2019). With the advancements of technology, and EHR data collection, it is easier to establish trends that account for correlation between personal health behavior and health outcomes (Nash et al., 2019). Both models focus on individual behavior, however personal health affects relationships and communities. Improving individual well-being and behavior can have a positive impact on population health.
The Health Belief Model focuses on individual perceptions of expectations and threats. Individual perceptions of susceptibility, severity, benefits, and barriers are the motivators behind health care decisions (Turner et al., 2004). Cues to action are external factors that can influence a behavior. Such cues to action could be information received by healthcare providers, educational sessions, social media campaigns (Turner et al., 2004). Self-efficacy is another aspect to include as a persons belief on their own ability to change their behavior (Turner et al., 2004). The example that Turner et al. (2004) discuss is related to osteoporosis prevention and highlights the impact that a health prevention program can have on the changes of lifestyle and behaviors of the target group. The authors accounted for individual motivators and barriers to increase perceived severity, perceived susceptibility, perceived benefits and self-efficacy to minimize risk of osteoporosis.
The Health Promotion Model, by contrast outlines three groups- individual characteristics and experiences, behavior specific cognitions and situational influences. While this theory is still greatly focused on individual perceptions, it recognizes the influence family, peers, social norms, and situational variations have on outcomes. The example that Srof and Velsor-Friedrich (2006) discuss highlights the extent interpersonal influences and vicarious experience affect adolescents physical activity level.

Compiling a Portfolio
As we work on our final portfolios lets once again consider some of the running rhetorical ideas weve been considering in English 10, purpose and audience, and how they might relate to how you choose to frame your Final Portfolio in your reflective cover letter. Your final portfolio is a chance for you to show what you’ve learned throughout the semester, and as you compile it there are some rhetorical moves you can make in your reflective cover letter to contextualize the materials you choose to put in your portfolio.
Read AWR: C4 Preparing a portfolio; reflecting on your writing 36-40. As you read, reflect on your audience and purpose in compiling your own final portfolio.
Your audience for the portfolio as a whole will be your instructor and your peers – what do you want to tell them? What do you want to convey about your experience in English 10 through your portfolio?
Writing a Reflection Letter
In addition to the final drafts of Writing Project #2 and #3 (but you may also discuss Writing Project #1 if you’d like) you will be revising one more time for your final portfolio, you will write an additional 2-3 page (600-900 word) reflection. The purpose of reflecting on the course, your writing, and your beginning of the semester reflections is to take stock on what you have learned over time. This writing project is meant to help me, you, and your peers understand what you learned over the course of the semester; this will support you in making goals for developing your literacy abilities in English 10 and other classes you take as a college writer.
Content
Over the course of the semester, we have focused on developing definitions, contexts, and applications for several key terms. These terms are listed in the schedule and include: 1) Rhetoric, 2) Inquiry, 3) Conversation, 4) Report, 5) Genre, 6) Audience, 7) Purpose, 8) Process, 9) Analysis. Using your Writing Project #2: Evaluations Essa’y as a starting point, and then reflecting on Writing Project #3 choose two to three terms above and discuss what you have learned about those concepts in our class and how you will use those ideas in other writing contexts.
For definitions of these terms
Final Product
The genre of this writing is a letter, so be sure to use what you know about letters, including a direct address for your readers and an informal tone, with a signature at the end, to create this piece. Additionally:
Name the key term you want to discuss.
Be sure to define what it means to you and discuss how you developed an idea of that meaning.
Tell readers also how you apply it to writing. Use examples to show readers how you think about and apply it.
Think about how you might use that concept in other writing or communication situations that are not from this class.
PLEASE NOTE:
The point is for you to write a focused, purposeful, reflective piece of writing that demonstrates what you learned in this class using evidence from your writing and the class to substantiate your claims, and analysis and reflection to consider the significance of those claims. NOTE: Please do not use this pape’r to talk about what a great class this was (or not) or how much you liked me as a teacher (or not).

Explain the difference between existing customers, target markets, and stakeholders for an acute-care county hospital that has historically taken care of those individuals who are less well insured or socioeconomically disadvantaged. The clinical staff is highly qualified and committed to the mission of the institution. In recent years the hospital has found that county support for its budget has decidedly decreased. In light of your description of the target market, existing customers, and stakeholders, how might this factor into a marketing directors concerns given budget realities and the need to attract a well-insured patient population?
For several years, the Steig Medical Group had been a successful primary care practice of three physicians. In recent years, the state in which it practiced became more receptive to opening the regulations to advanced practice nurses for providing primary care services to the limit of the license without direct supervision and to even have pharmacists perform limited diagnosis, order lab tests of certain types, and provide consults under some relationship with a physician. These pharmacists could also refer. The local Walgreens and three CVS location in town had also opened Minute Clinics staffed with nurse practitioners. The Steig group just recently offered weekend hours on Saturday and had walk-in hours from 7:30 a.m. until 8:15 a.m. on Tuesday and Thursday mornings. The practice closed Monday through Thursday at 5 p.m. and Friday at 3:30 p.m. Over lunch, the three doctors, all close friends who went through medical training together, decided to meet on a Sunday morning. One of them had recently completed a master’s of business administration at the local business school. “I think we should do a SWOT analysis of the practice,” he said, “I think we now have real competition from when we started 10 years ago. The nurse practitioner practice is now open three nights a week and is opening Saturday and Sunday morning. The Minute Clinics are also there. Let’s step back. Our practice is busy. We were voted best primary care group last year in Midtown magazine, but how long will that help? We have all been here in the community, we have talked about hiring, but is it enough? What else should we be doing?” Conduct a SWOT analysis for the Steig group.
Two large multispecialty medical groups have recently asked you to conduct audits using the BCG matrix. For the first group your analysis reveals the following distribution of services: 65% cash cows, 10% stars, 20% problem children, and 5% dogs. In the second group, the distribution is as follows: 20% cash cows, 60% stars, 15% problem children, and 5% dogs. Provide your analysis and recommendations for each group.
Having just been recruited to a new community in Florida as the senior vice president for marketing, you realize that a review of the demographics shows the community was slightly older than you were initially told. As an attractive community, the area was increasingly drawing a large number of recently retiring seniors whose income was relatively good. The challenge was that the primary and secondary service area was ringed with several good, competing facilities. At the other end of the distribution, there was a segment of the elderly who had been in the community and whose health might be considered fragile. The health system had now decided to form an accountable care organization. What are the key challenges for the population of these two segments? Outline the major marketing objectives for each group. Do they differ? Are there programmatic differences? How might the four P’s differ in responding to each market segment?
End of chapter conceptual problems evaluate your understanding of key concepts and elements of the Health Care Marketing learned in the chapters. Showing an understanding of the problems using clear logic and supporting facts, you must address the problems analytically and thoroughly. The Assignment must follow the following guidelines:

THE BASICS: You will write an short responce (roughly 1,000 words) that compares and contrasts two artworks. How are they similar? How are they different? In the process, we will uncover the connections between two different people in two different times and places.
Choose one of the possible pairs listed below:
OPTION 1:
Buddhist Temple of Borobodur, 9th century CE (Southeast Asia) – image found here
Great Mosque of Isfahan, originally begun 9th century CE (Islamic) – image found here
You will discuss the similarities and differences between two examples, based on:
Visual analysis (what do they look like)
Describe in detail how the artworks are similar or different.
Be sure to take into account whether the work of art you selected is a two-dimensional or three-dimensional, whether it is a work of art or architecture, functional or decorative, etc.
Is one colorful whereas the other one lacks color? How do the colors relate to the materials used? What might color communicate in these examples?
What is the subject matter of each artwork? Is it a representation of something or is it nonrepresentational?
If it is representational, is it an abstraction of something? Are certain elements exaggerated? Is one example much larger or smaller in scale than the other?

As we wrap up the term and finish up the compare and contrast short responce, it’s time to reflect on what we’ve learned. For this week’s discussion board, please share (at least 300 words):
Out of all the artworks we learned about this term, which artwork challenged your preconceived ideas or views about art (its purpose, function, and/or aesthetics, etc.) — or about a particular region? Explain — is it different from the kinds of art forms that you were already familiar with? Was the material unique?
Do you think this artwork should have a place in the “art historical canon“ — the list of “greatest hits” of art history, among masterpieces like the Mona Lisa, for example? Explain.
Please include an image of the artwork you chose and include the title, artist’s name (if known), country or region of origin, medium, and date that it was created.
Note: this discussion board post is worth 40 points rather than 20, so make sure that your post reflects the extra effort (at least 300 words, address all discussion prompts). Make sure to respond to at least two classmates (at least 75 words each) to push the conversation forward in some way.

Assignment #2
Creative writing in response to literature is a way for students to respond to literature in a personal way. Creative writing provides a way for students to practice critical thinking and develop a stronger understanding of literary criticism while showing creativity and a bit of their own personalities. For this creative writing assignment, you will do a character analysis to allow you to get inside the mind of one of the characters. “Rip Van Winkle” and “Young Goodman Brown” are told as third-person narratives, not as first-person narratives. The difference is that a third-person narrative presents the characters to us in the words of a narrator rather than from the words of the characters themselves. The story contains descriptions such as Rip Van Winkle did this or Young Goodman Brown said that, but its not as if the characters themselves are telling everything from their perspective. Of course, sometimes they speak in the story, but they do not get to tell the story or what they thinking or feeling. It is up to the reader to determine what the characters might be thinking or feeling. For this assignment, choose one of the following options: (A) Imagine you are Rip Van Winkle’s daughter, Judith, writing a journal entry after her father reappears after 20 years. Try to get into the mind of Judith. Be imaginative and creative. Pretend you are Judith and have just seen your father after he has been missing for 20 years. You will not be retelling the plot of the story; you will be Judith reflecting on the events of the day. In this journal entry you can put down whatever thoughts she might have using absolute frankness and honesty.? OR(B) Imagine you are Young Goodman Brown writing a journal entry the day after the events described in the story. Try to get into the mind of Goodman Brown. Be imaginative and creative. Pretend you are Goodman Brown and have just experienced the events described in the story. You will not be retelling the plot of the story; you will be Goodman Brown interpreting and reflecting on the events of the day. In this journal entry you can put down whatever thoughts Goodman Brown might have using absolute frankness and honesty.? Criteria:
Write a minimum 400 words in paragraph form, using Times New Roman 12-point font (or similar) with double spacing. A title page is not required.

Discussion board replies | CJUS 410 – Constitutional Criminal Procedure
I need two replies to this discussion board on either agreeing or disagreeing. 150 words for each reply, the original discussion is attached.
Hello class,
To outline my position on if the Dripps’ model would work in the real world, I must first outline my positions on the exclusionary rule and restorative justice. The Exclusionary Rule was enacted by the United States Supreme Court to not allow any evidence into criminal proceedings that was obtained while in violation of a defendant’s rights. Most often, this suppression of evidence was in part to an officer’s lack of experience when conducting constitutional searches and seizures, or done knowingly by the officer. In a scholarly article published by Sage Journals, “…suppression hearings enforce Fourth Amendment protections not only by barring illegally seized evidence from being used at trial, but, also, by using the data they generate to educate and monitor police officers” (Nir, 2020, p. 105). With these protections in place, thought processes have also shifted to developing a more well rounded resolution to an outcome by implementing restorative justice.
So what is restorative justice? In The Little Book of Restorative Justice, the author states there are, “Three central concepts or pillars deserve a closer look: harms and needs, obligations, and engagement” (Zehr, 2002, p. 22). Zehr goes on to explain that restorative justice is a concept that focus on how the victim was harmed and what they are needing from the outcome. Additionally, he explains what obligations do the courts have to the victim and how will they hold the offender accountable? Finally, Zehr addresses how the community, offender, and victim should be engaged with the process to make restorative justice successful. These three pillars, or concepts, form the baseline for what restorative justice is and why it should be implemented. Donald Dripps attempts to take a more “hybridized” approach to both concepts when he developed his model of contingent suppression.
Dripps proposed that if evidence was seized in the violation of a defendant’s rights, then why not allow the evidence if the courts found sufficient remedial action in its place. An example of this, as Dripps states is, “…suppress tainted evidence, then give the prosecution the opportunity to prove the precise, concrete steps the department has taken to prevent recurrence? If the court finds the corrective action adequate, the evidence can be received; if not it would be suppressed” (Dripps, 2009, p. 2). This way of thinking proposes that if the police were to obtain evidence illegally by violating the defendant’s rights, the courts could still allow the evidence should the department provide a better means of compensation for the infraction.
I do not believe this model would work in the real world for a number of reasons. First, the Fourth Amendment was established to protect the people from unreasonable searches and seizures. who is to say that if Dripps’ methodology enables law enforcement to conduct more violations for the sake of replacing one wrong with a corrective action in the hopes to permit evidence? Additionally, while Dripps argues that this would hold police accountable for their actions and potentially deter future violations, the fact remains that people’s Fourth Amendment rights are still being violated by not only the illegal search, but its admissibility as evidence should the courts deem the corrective action in its place appropriate. Second, it is proposed that departments could have to pay fines associated with the violation that are of equal or more substantial worth than the infraction. There is no basis, nor way of knowing what violation would occur what penalty as each violation is different and this model is not a program adopted by any state or federal agency. Finally, officers would be less inclined to perform their duties in making reasonable arrests, due to the fear of being reprimanded and their department having to pay should they make an error in judgement. I believe that Dripps’ model is a slap to law enforcement officials and furthers the interests of the courts than it does to protect the people.
I do not believe that Dripps’ model is compatible with restorative justice, as it appears to only target the well being of the judicial system. Dripps’ model would be more compatible with restorative justice by addressing the needs of the victim through appropriate compensatory measures and holding the offender accountable for their actions. In the Book of Zechariah 7, verse 9 the Bible states, “This is what the LORD Almighty said, “”Administer true justice; show mercy and compassion to one another” (New International Version, 2011). This scripture personifies restorative justice by showing that not only should we address the needs of the victim and be compassionate towards their cause, but we must show mercy to the offender as well. The offender should be afforded the protections of their rights, and should evidence be obtained that is in violation of their Fourth Amendment rights, then that evidence should not be permitted during the criminal proceedings. By addressing the needs of the victim, holding the offender accountable, and protecting the rights of all parties involved, it is only then that the community can engage in bringing about resolution to the conflict and restoring justice.
